Terms of Service

Tide Friend — Terms of Service · Last Updated: June 29, 2026

These Terms of Service (“Terms”) are between you and Mintzi LLC (“Mintzi,” “we,” “us”), publisher of Tide Friend (the “App”). By downloading, installing, or using the App you agree to these Terms. If you don’t agree, please don’t use the App.

1. License

Subject to these Terms, we grant you a personal, non-exclusive, non-transferable, revocable license to install and use the App on Apple-branded devices that you own or control, for your personal, non-commercial use. The App is licensed, not sold.

Because the App is distributed through the Apple App Store, Apple’s Licensed Application End User License Agreement (the “Apple Standard EULA”) also applies and is incorporated into these Terms by reference. Where the Apple Standard EULA and these Terms conflict, the stricter restriction on your use of the App applies.

2. Tide data — important safety notice

Tide data shown in the App is for general planning and educational purposes only. It must not be used as the sole basis for marine navigation or any safety-critical decision.

Please understand the limits of what the App shows:

  • Tide heights, high/low times, and slack-tide periods are predictions generated from harmonic models published by the National Oceanic and Atmospheric Administration (NOAA) and other public tide-data providers. They are not real-time measurements.
  • Actual water level can differ significantly from predictions due to weather, wind, atmospheric pressure, river outflow, storm surge, earthquakes, or local geography. For some stations the App interpolates a curve between published high/low extremes, which is an approximation, not a measurement.
  • Sea-surface water temperature is supplied by a third-party model (Open-Meteo Marine) and may not reflect local conditions.
  • Station names, locations, and coverage depend on third-party providers and can change without notice.

For navigation, boating, fishing, swimming, surfing, diving, beach access, or any activity where water level matters to your safety, always consult official nautical charts, harbor authorities, the U.S. Coast Guard or your local equivalent, NOAA’s official tide tables, and current on-site conditions. Never rely on Tide Friend alone.

3. Acceptable use

You agree not to:

  • Use the App in any way that violates applicable laws or regulations.
  • Reverse engineer, decompile, or attempt to extract source code from the App, except to the extent expressly permitted by applicable law.
  • Use the App to overload, abuse, or attempt to gain unauthorized access to the third-party tide and weather services it talks to.
  • Remove or alter any copyright or attribution notices in the App.

4. Third-party services

The App fetches tide predictions, water temperature, and station data from independent third-party providers (NOAA, Tides Atlas, Open-Meteo) and renders maps using Apple MapKit. Your use of those services is governed by their own terms of service and privacy policies. We do not control and are not responsible for the availability, accuracy, or content of those services.

5. Intellectual property

The App, including its design, code, mascot, icons, and original text, is owned by Mintzi LLC and protected by copyright and other intellectual property laws. Tide data, station names, port information, map tiles, and water-temperature data are provided by the third parties listed in Section 4 and remain their property.

6. No warranty

THE APP IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP, OR THE TIDE OR WEATHER DATA IT DISPLAYS, WILL BE ACCURATE, COMPLETE, UNINTERRUPTED, ERROR-FREE, OR AVAILABLE IN ANY PARTICULAR JURISDICTION.

7. Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT WILL WE, OUR AFFILIATES, OR OUR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATED TO YOUR USE OF, OR INABILITY TO USE, THE APP OR ANY TIDE OR WEATHER DATA SHOWN IN IT — INCLUDING ANY INCIDENT INVOLVING NAVIGATION, BOATING, FISHING, SWIMMING, SURFING, DIVING, BEACH ACCESS, PROPERTY DAMAGE, OR PERSONAL INJURY. WHERE LIABILITY CANNOT BE EXCLUDED BY LAW, OUR TOTAL LIABILITY FOR ANY CLAIM RELATED TO THE APP IS LIMITED TO THE AMOUNT YOU PAID FOR THE APP IN THE TWELVE MONTHS PRECEDING THE CLAIM (or, if the App is free, USD 0).

Nothing in these Terms excludes or limits liability that cannot be excluded or limited by applicable law (for example, liability for death or personal injury caused by negligence, or for fraud).

8. Apple-specific terms

You and we acknowledge that these Terms are between you and us only, and not with Apple. Apple is not responsible for the App or its content. Apple has no obligation to provide maintenance or support for the App. In the event of any failure of the App to conform to any applicable warranty, you may notify Apple, and Apple may refund the purchase price (if any) to you; to the maximum extent permitted by law, Apple will have no other warranty obligation with respect to the App. Apple and Apple’s subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.

9. Subscriptions and payments

Tide Friend offers an optional auto-renewable subscription, Tide Friend Pro, which unlocks the App’s full features. It is available as a monthly or yearly plan and may include a free trial. The price and billing period are shown in the App, in your local currency, before you confirm any purchase.

  • Payment is charged to your App Store account when you confirm the purchase. If your subscription includes a free trial, the trial automatically converts to a paid subscription and payment is charged when the trial ends, unless you cancel at least 24 hours before the trial ends.
  • The subscription renews automatically for the same period at the then-current price unless you turn off auto-renewal at least 24 hours before the end of the current period. Any unused portion of a free trial is forfeited when you purchase a subscription.
  • You can manage your subscription, turn off auto-renewal, or cancel at any time in your App Store account settings. Deleting the App does not cancel your subscription.
  • Subscriptions are sold and billed by Apple through the App Store. Refunds are handled by Apple in accordance with Apple’s policies; we cannot issue refunds directly. We use RevenueCat to verify and manage subscription status.
  • If we change the subscription price, the new price will not apply to your existing subscription until the next renewal after we give you notice, and where the App Store requires it, only after you agree to the new price.

10. Termination

These Terms remain in effect while you use the App. You may stop using the App at any time by deleting it from your device. We may suspend or discontinue the App, in whole or in part, at any time. Sections that by their nature should survive termination (including Sections 2, 5, 6, 7, 9, and 11) will survive.

11. Governing law

These Terms are governed by and construed in accordance with the laws of the United States and the state in which Mintzi LLC operates, excluding its conflict-of-laws rules. The Apple-specific terms in Section 8 apply in addition.

12. Changes to these Terms

We may update these Terms from time to time. When we do, we will update the “Last Updated” date above. Material changes may also be announced in the App Store update notes. Continued use of the App after a change means you accept the revised Terms.
